The government is preparing to lift the suspensive measure of several subdivisions between Dakar and Thiès, following the 45-day extension decreed on November 7. In a new note, the General Secretariat of the Government informs that the lifting of the suspension will be pronounced on the due date for plots without issues. It is in this regard that « the holders of rights on the Pud or plots in Boa, Hangar des pèlerins, Recasement 2, Eogen 1 and Eogen-extension, yje northern zone of the Bande des filaos in Guédiawaye, Yeumbeul-Malika-Tivaouane Peulh, Pointe Sarène, Mbour 4 are requested to fill out a lot identification form and submit it to the headquarters of the General Directorate for the Surveillance and Control of Land Use (DGSCOS) ».
After the extension for 45 days of the suspensive measure of several subdivisions between Dakar and Thiès, the General Secretariat of the Government informs through a note that the lifting of the suspension will be pronounced on the due date for plots without issues. But, the owners will first have to fill out a lot identification form at the headquarters of the General Directorate for the Surveillance and Control of Land Use (DGSCOS). In its document, the General Secretariat of the Government asks « the holders of rights on the Pud or plots” in the aforementioned zones “to complete a lot identification form and submit it to the headquarters of the General Directorate for the Surveillance and Control of Land Use (Dgscos), located at the Vdn, next to the Exclusive Hypermarket, or to the Zonal Brigade of the Dgscos of Mbour, or to send it to the email address: [email protected].”

It is also specified that « the form can be collected from the Dgscos, in the various offices of the Domains concerned or downloaded from the website www.dscos.gouv.sn ». The government informs that a « discharge in lieu of release will be issued, on a case-by-case basis, after analysis of the information provided ».
Concerning the « Development Plan for the New City of Thiès and the development of Ndiébène Gandiole, decisions relating to the processing of allocations will be notified subsequently to the persons concerned ». In the same document, it is emphasized that with regard to « the plots of Egbos, the urban centers of Diacksao, Bambilor, Déni Birame Ndao, Yenne and Daga Kholpa, the work of the committee is continuing ».
Towards the lifting of the measure in certain areas and under conditions
It should be recalled that by a press release dated November 7, 2024, the General Secretariat of the Government informed the public of « the extension, for 45 days, of the suspensive measure of the plots in Boa, Hangar des pèlerins, Recasement 2, Eogen 1 and Eogen-extension, of the following Detailed Urban Planning Plans (PUD): Mbour 4, Nouvelle Ville de Thiès, Bande nord des filaos de Guédiawaye, Yeumbeul-Malika-Tivaouane Peulh, the urban poles of Diacksao, Bambilor, Déni Birame Ndao, Yenne and Daga Kholpa». The extension of the suspension also concerns Egbos, Pointe Sarène and Ndiébène Gandiole.

The authors also specify that they indicated in the said document « that the areas and plots which did not present any particular problems would be subject to lifting of suspension at the latest at the end of the extension period ».

It is indeed quite disconcerting for an authority that has all the structures of the State under its command to decide to freeze work worth several million CFA francs, to put contractors, their masons, carpenters and day laborers on technical unemployment, to block the resources of their suppliers… in short, to paralyze the activity of a large part of the construction sector, just on the basis of presumptions, without any proof.

Since for many years, the current power holders have always denounced a nebulousness in land allocations, it was expected that they would indicate to the public the reasons why certain plots were targeted. Indeed, the Tax and Estates services, the Land Registry Directorate or even the requisitions from certain notaries should have been enough to provide elements as to the regularity or otherwise of certain allocations. Instead, the Dgscos is now asking the beneficiaries to justify their property rights, without even having been the subject of conflict with other claimants.

The public authorities are therefore reversing the burden of proof. For them, it is up to the presumed accused to demonstrate the legality of their acquisitions, by presenting evidence that is supposed to be available to the various government departments. A silly question: would it not have been simpler, instead of blocking a part of the economy, to carry out the necessary investigations into certain property titles, to ask those concerned to present their supporting documents, before moving on, eventually, to the stage of suspending the works?
